This Privacy Policy (“Policy”) applies to Acuity EyeCare Holdings, LLC d/b/a AEG Vision’s, its parent company and other affiliates, and AEG Vision’s supported practices’ (collectively “AEG Vision” or “We”) collection and use of your personal information through its website www.aegvision.com and those of AEG Vision’s supported practices linking to this Policy (each a “Website”). AEG Vision provides nonclinical business support services to optometry practices. These practices are solely responsible for delivering optometry and related dispensary services (the “Services”) directly to patients.
This Policy explains our information practices with respect to interactions with you online or via text, the kinds of personal information we may process, how we use and share that personal information, and how you can exercise the choices you may have under applicable law. Please read this Policy carefully. By using the Services and Website, you agree to the collection and use of your information in accordance with this Policy. If you do not agree with this Policy, you may not use this Website or our Services.
We may update our Policy from time to time and will notify you of the same either by contacting you or by updating the “Last Updated” date above. Please review this Policy periodically for any changes. Changes to this Policy are effective when they are posted on this page, or when you receive any notice prescribed by law.
Applicability
As used in this Policy, “personal information” means information that can be reasonably linked to an identified or identifiable individual, but does not include “PHI”, as defined by the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”). This Policy does not apply to information collected from you in person, including PHI, when you visit any practice supported by AEG. AEG Vision only markets to and provides Services in the United States. By visiting a Website or requesting Services, you agree to the transfer of your personal information to, and storage in, the United States. If you are from a jurisdiction that requires consent for cross-border transfers and wish to delete your personal information, please see “Your Rights and Choices” below. AEG Vision does not provide Services or attempt to provide Services in any other country. AEG Vision makes no claims that materials on this Website are appropriate or may be fit for use in locations outside the United States. Access to this Website from countries or territories where such access is illegal is prohibited. Those who access this Website from outside the United States do so on their own initiative and are responsible for compliance with local laws, rules, and regulations.
Children’s Privacy
Neither the Website, nor our Services, are directed toward or intended for people under the age of 16. We do not collect, and we are forbidden from processing or selling, personal information from any person we have actual knowledge is under the age of 16. Users under 16 years of age are not permitted to use and/or submit their personal information at the Website and must have a parent or legal guardian submit personal information on their behalf. AEG Vision does not knowingly solicit or collect personal information from people under 16 years of age. Although we choose our Website links carefully, AEG Vision is not responsible for, has no liability for, and has no control over the privacy practices of websites and mobile applications operated by any third parties. We collect personal information from the following categories of sources:
- Directly from you when you create a unique account to hold your personal information for purposes of treatment, payment, or health care operations (an “Account”), inquire about our Services, schedule an appointment, review our Services, participate in any interactive features of our Website or other Services, fill out a form, communicate with us via third party social media sites, request customer support, or otherwise provide us with information about yourself.
- Directly and indirectly from your activity on the Website. Our Websites automatically collect information about your use of the Website (“Usage Data”). Usage Data includes (a) the type of browser you are using, (b) your domain type and server, (c) your IP address, (d) the URL you have come from, (e) the pages of our Website that you have visited, date/time stamp and the time spent on those pages, (f) the approximate location of where you accessed our Website or Services, (g) cookies as further described below, and (h) other statistics. This kind of information is collected by many sites. We perform statistical and other analysis on the Usage Data to (i) analyze and measure user behavior and trends, (ii) to understand how people use our Services, (iii) to monitor, troubleshoot and improve our Services, including to help us evaluate or devise new features, and (iv) create Aggregate Data. - From third parties who interact with you, for example from social media, advertising platforms, or financial services providers. We collect this information to better tailor our advertisements, allocate resources, and improve our Services.

Please note that we do not collect biometric information as defined by applicable law. While we may collect iris scans from you in person, we do not collect genetic information, nor do we use any biometric information to track or form a profile about you for identification purposes. The applicable HIPAA notice presented to you at that time will govern our collection and use of any such information.
In some states, a health condition or diagnosis is considered “sensitive personal information” or “sensitive data” under applicable law. You may choose to provide any information related to your health condition but are not required to as a condition of using our Website or Services. We only collect and process this information as strictly necessary to provide you with the Service(s) you request.
We collect the following categories of personal information from third parties:
- Identifiers from data brokers, advertising platforms, and social media companies
- Internet or similar network activity from advertising platforms, social media companies, and third party cookie providers
- We receive information about your creditworthiness or financing status from third party credit and financial services providers if you apply for financing through them for our Services.
How We Use Your Personal Information
We use your personal information for one or more of the following business purposes:
- To provide Services, including booking and confirming your appointment as well as providing treatment and examination services;
- To manage your Account, including processing any necessary claims to insurance company(s), billing outstanding balances, or issuing refunds if necessary;
- To contact you by email, telephone calls, texts, or other equivalent forms of electronic communication, such as a mobile application’s push notifications regarding updates or informative communications related to the functionalities, products, or contracted Services, including the security updates, when necessary or reasonable for their implementation;
- To provide you with news, special offers and general information about other goods, services, and promotions which we offer that are like those that you have already purchased or enquired about unless you have opted not to receive such information;
- For data analysis, identifying usage trends, determining the effectiveness of our promotional campaigns and to evaluate and improve our Service, products, marketing, and your experience;
- To fulfill or meet the reason for which the information is provided;
- To carry out our obligations and enforce our rights;
- To improve the Website and Services and better present them to you;
- For customer service purposes and to respond to inquiries from you;
- For testing, research, analysis and product development;
- As necessary or appropriate to protect our and your rights, property or safety, and that of others;
- To evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution or other sale or transfer of some or all our assets or business, whether as a going concern or as part of bankruptcy, liquidation or similar proceeding, in which personal information held by us is among the interest or assets transferred; and

We will not collect additional categories of personal information or use the personal information we collected for materially different, unrelated or incompatible purposes without first updating this Policy.
How We Share Your Personal Information
In addition to the above table, we share your personal information for the following purposes with the respective third parties noted below, as applicable.
- Advertisers and Other Third Parties. AEG Vision shares information, including information that identifies you, to advertising companies, platforms, and service providers.
- Targeted Advertising. We share your personal information for purposes of targeted advertising. You may opt out by using our webform as described below.
- Vendors and Service Providers. We disclose personal information to vendors and service providers retained in connection with the provision of our Services. This includes, for example, vendors that provide services to AEG Vision for marketing, analytics, fraud prevention, account security, and customer service, including using artificial intelligence services. These service providers are contractually prohibited from using the information we provide for purposes other than performing services for AEG Vision.
- Merger, Sale, or Other Transactions. We may disclose your information, including information that identifies you, to effect a corporate transaction involving AEG Vision, including a merger, acquisition, financing, or otherwise, and to support the sale or transfer of our business assets or equity interests.
- As Required by Law, to Enforce Laws and Similar Disclosures. We may disclose your information, including information that identifies you, to defend ourselves in litigation or a regulatory action; when required or advised to do so by law, such as in response to a subpoena, or similar legal process, including to law enforcement agencies, regulators, and courts in the United States and other countries where we operate; to enforce our rights or protect our property; to protect the rights, property or safety of others, investigate fraud, or respond to a government request; or as needed to support auditing and legal compliance functions.
- Analytics. We use third-party services such as Google Analytics to help us understand how visitors interact with our Website and to help improve our user experience.
- Aggregate Data. As used herein, “Aggregate Data” means we or our service providers create during processing of information, such that (i) no personal information may be derived from such aggregate data (ii) such aggregate data cannot reasonably identify, relate to, describe, be capable of being associated with, or be linked, directly or indirectly, to a particular individual, and (iii) AEG Vision has implemented technical safeguards and business processes that prohibit reidentification of the individual. We collect and share Aggregated Data for any lawful purpose, including without limitation to our service providers.
- Consent. With your consent, as prescribed by applicable local law.
How We Retain Your Personal Information
In general, AEG Vision will retain your personal information as long as needed to provide you with our Services, to operate our business, and comply with applicable laws. If you ask AEG Vision to delete specific personal information, we will honor this request unless deleting that information prevents us from carrying out necessary business functions and complying with applicable law, like billing for our Services, calculating taxes, conducting required audits, or records retention under HIPAA or state medical records act laws. Subject to the foregoing, we will retain your personal information for the longer of as long as you have an Account with us, plus ten years. We do not store your payment information. We keep your email if you do not revoke your consent to direct marketing. We will retain the rest of your personal information as long as we deem reasonably necessary to provide the Services, secure our systems, and protect ourselves from liability. We are developing ways to retain your data for shorter periods and will update this Policy accordingly.
Please note that if you request that we delete your personal information, it may take up to 30 calendar days from our response to you for personal information to be completely removed from our systems. In some cases, a copy of those records, including the personal information contained in them, may be retained to carry out necessary functions like billing, invoice reconciliation, troubleshooting, and detecting, preventing, and investigating spam, fraudulent activity, and network exploits and abuse. Legal matters may also require us to preserve records, including those containing personal information. These matters include litigation, law enforcement requests, or government investigations. If we must do this, we will delete the impacted records when we are no longer legally obligated to retain them. We retain Aggregate Data indefinitely and may use it for any lawful purpose.

To protect your privacy, AEG Vision will take steps to verify your identity before fulfilling your request.Depending on where you live, you may have the right to opt out of targeted advertising through a Global Privacy Control (GPC) enabled browser setting. If you have this right, when you visit and log in to our Websites in a GPC-enabled browser, we will treat our initial receipt of the GPC signal as a valid request to opt-out of targeted advertising, as defined by applicable U.S. privacy laws granting this right, for the device and, if linked to an individual, that individual. Other than GPC, we do not recognize any “do not track” signals.
Your Rights and Choices
Under applicable laws, you may have some or all the below rights in and to your personal information. Please note that while some of the options below may assist you in opting out of advertising tailored to you, you will still see advertisements on certain sites.
- Opt Out of Sale and Sharing. To opt out of the sale or sharing of your personal information for targeted advertising purposes by AEG Vision, please click .
- AEG Vision Marketing Opt Out. You may opt out of receiving promotional e-mail from AEG Vision. For e-mail, individuals may opt out at any time by using the unsubscribe mechanism within the e-mail, which allows individuals to manage their subscription preferences regarding AEG Vision offers. This mechanism does not allow a user to opt out of receiving transactional e-mail, such as appointment confirmation, updates, and responses to direct requests.
- Right of Access. You may request access to the personal information that AEG Vision has processed about you. If you choose to request such access, you will receive both an email confirming our receipt of your request and a follow-up email with the information addressing these questions. Specifically, you may ask us to tell you: (a) the categories of personal information we have processed about you; (b) the categories of sources from which the personal information was collected; (c) the business or commercial purposes for which AEG Vision has sold, or shared your personal information; (d) the categories of third parties to whom AEG Vision has disclosed your personal information; and (e) the specific pieces of your personal information AEG Vision has processed and shared or sold. If you request such access, to the extent any of the above apply to your personal or business information, we will provide you the information by email in a portable and readable format.
- Right to Know. You have the right to know the categories and specific pieces of personal information that we may process and sell about you, the categories of sources from which we shared or sold your personal information, our purposes for collecting or selling your personal information, the categories of your personal information that we have either sold or disclosed for a business purpose, and the categories of third parties with which we have shared personal information. That information is in the above table.
- Right of Deletion. You have the right to request that we delete any of your personal information that we process and sell, subject to certain exceptions; for example, we may not be able to verify that we have your personal or business information and may need the name of the practice that collected the applicable information to process your request. Subject to the time period allotted to comply with such requests, where we receive and confirm your verifiable deletion request, we will delete (and direct our service providers, contractors and/or third parties to whom we sold/shared your personal information, to delete) your personal information from our (their) records, unless an exception applies; provided, however, that in some cases, strictly for regulatory compliance purposes and to better evidence/honor opt-out/unsubscribe requests, we may retain certain items of your personal information on a de-identified and aggregated basis in such a manner that the data no longer identifies you. We may deny your deletion request if (I) an exception to deletion applies under applicable law, or (II) retaining the information is necessary for us or our service providers, contractors and/or third parties to whom we sold/shared your personal information, to:

- Right to Opt Out of Profiling. You have the right to opt out of any Profiling that may be conducted by us. For purposes of this Policy, “Profiling” means a form of advanced automated processing performed on your personal information to evaluate, analyze or predict personal aspects related to you or your economic situation, health, personal preferences, interests, reliability, behavior, specific geolocation, or movements. We do not currently conduct Profiling and will update this Policy if we do.
- Right of Correction of Inaccurate Personal Information. You have the right to request correction of inaccurate personal information that we process. Upon receiving a verifiable consumer request for correction, we will make commercially reasonable efforts to correct information identified as inaccurate that we store about you. Where we correct inaccurate personal and/or sensitive personal information, we shall instruct all service providers and/or contractors that maintain such personal and/or business personal information while providing services to us to make the necessary corrections in their respective systems.
- Right of Portability. You may request that we provide your personal information in a portable format. If we authenticate your request, we will transfer to you the personal data that we have collected and maintain about you, subject to exclusions under applicable law through a secure method in a commonly used electronic format that, to the extent technically feasible, is readily usable and allows you to transmit the personal data to another entity without hindrance.
- You have the right to request a list of the specific third parties to whom we have disclosed personal information.
- Right to Opt Out of Processing of Sensitive Personal Information. You have the right to opt out of our processing of your sensitive personal information, provided that without such information we may be unable to provide Services and certain functionalities of the Website. Under California law, you may request that we limit the processing of sensitive personal information if we are using or disclosing it for purposes other than those specified in Cal. Code Regs. Tit. 11, § 7027(m). Currently, we are not using or disclosing any sensitive personal information for purposes other than those specified in Section 7027(m).
- Right to Non-Discrimination. We will not discriminate against you for exercising any of your rights under this Policy. Specifically, we will not:
- Deny you goods or services;
- Charge you different prices or rates for goods or services;
- Provide you a different level or quality of goods or services;
- Retaliate against any employee, job applicant or independent contractor; and/or
- Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.
- Response Timing and Format. We endeavor to respond to all verifiable requests within thirty days of receipt. If we require more time, we will inform you in writing. We will deliver our written response by mail or electronically, at your option. Any disclosures we provide will only cover the twelve (12) month period preceding the receipt of your verifiable request. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance. We do not charge a fee to process or respond to your verifiable request unless it is excessive, repetitive, or manifestly unfounded. If we determine that a request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.
- Authorized Agents. You may permit an authorized agent to exercise any rights granted under applicable state laws as set forth above. To utilize an authorized agent, you must provide the authorized agent with written permission from you to act on your behalf for these purposes. When you use an authorized agent to submit a request, we may require the authorized agent to provide proof that you gave the agent signed permission to submit the subject request. We may also require you to directly confirm with us that you provided the authorized agent permission to submit the request. Authorized agents may submit requests by emailing [email protected]. We may contact you directly to verify the authorized agent’s status before completing such a request.
- Exercising Your Rights. You can exercise any of your rights listed above by visiting our webform , writing us at the contact information below, or emailing us at [email protected]. Additionally, you may request that we not sell or share your personal information by selecting the in the footer of our Website.
- Verification and Appeal. We use a two-step information verification process to validate identity before requesting modification to personal and business information. To appeal our decision regarding a request related to these rights, you may email us at [email protected]. In certain circumstances, we may decline a request to exercise the right, particularly where we are unable to verify your identity or if an exception applies.
AEG Vision US Short Code Terms of Service for Text Messaging
A short code is a special telephone number designed for high-throughput, two-way messaging. Short codes are used to send and receive SMS and MMS messages to and from mobile phones.
- If you opt-in to receiving texts from us, we will send SMS messages with updates related to appointments, eyewear pickup notifications, and annual exam reminders.
- You can cancel the SMS service at any time. Just text to the short code. After you send the SMS opt-out message to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.
- If you are experiencing issues with the messaging program you can reply with the keyword HELP for more assistance, or you can get help directly at [email protected].
- Carriers are not liable for delayed or undelivered messages.
- As always, message and data rates may apply for any messages sent to you from us and to us from you. You may receive up to 5 messages per month. If you have any questions about your text plan or data plan, contact your wireless provider.
Security
The security of your personal information is important to us. AEG Vision takes reasonable and appropriate efforts to encrypt your personal information at rest and in transit, to prevent unauthorized access, alteration, or destruction of personal information. AEG Vision uses industry-standard practices for data encryption and storage, such as SHA-256 encryption with a 2048-bit key. Although we use commercially reasonable efforts to help protect your personal information, we cannot guarantee the security of personal information transmitted to this Website. Please be aware that there is no such thing as perfect security on the internet, and third parties may unlawfully intercept or access transmissions or private communications and accordingly email and other transmissions to and from this Website or made via this Website may not be secure. Any transmission of personal information to us is at your own risk. We are not responsible for your or third party circumvention of any privacy settings or security measures on this Website.
